Special Education Information Center | Manifestation Determination Review

Preferred Video Hosts URL

My student had a discipline incident at school and is being sent to the alternative campus for fifteen days. Now I've received an invitation to a manifestation determination review. What happens at the meeting? When a student with a disability engages in behavior or breaks the student code of conduct and the school proposes to remove the student from their current educational setting or placement, for example, send the student to the discipline center or alternative school, a Manifestation Determination Review must be held. The members of the Manifestation Determination Review are the same as the members of the Admission Review and Dismissal Committee. The ARD Committee members must review all relevant information in the student's files to include the IEP, teacher observations, and relevant parent information. The members must determine upon reviewing the information: one. If the conduct in question was caused by or had a direct and substantial relationship to the student's disability or two. If the conduct in question was a direct result of the school's failure to implement the student's IEP. Upon answering the questions above, the members of the ARD committee make the following determinations: one. The behavior or conduct was a manifestation of the student's disability, thus the student must remain in their current educational setting or placement. Or two. The behavior or conduct was not a manifestation of the student's disability, thus the school may apply the relevant disciplinary procedures. During the period of removal, services must continue to be provided to allow the student to continue to receive a free, appropriate public education. Learn how the Manifestation Determination Review (MDR) process is used when a student with a disability faces possible disciplinary removal from school. This video explains the role of the admission, review, and dismissal (ARD) committee in reviewing the student’s individualized education program (IEP), teacher input, and other relevant data to determine whether the behavior was caused by the student’s disability or by a failure to implement the IEP. It also highlights the legal protections in place for students with disabilities and outlines possible outcomes, including continued access to educational services if a change in placement occurs.
